The Employee Appeals Board is an administrative tribunal of three hearing officers appointed by the State Personnel Board. MSPB provides administrative support for the daily operations of the EAB, while the hearing officers make decisions independently.
While EAB hearings may be open to the public, the hearing officer may decide to close the hearing (or parts of the hearing) to the public when it is in the best interest of witnesses, victims, or other parties, or to comply with state or federal law.
Policy regarding recording hearings:
Section 9.19 of the State Employee Handbook prohibits the recording of the EAB hearing. “In order to maintain appropriate confidentiality and maintain the integrity of the official record, no other recording of the hearing, or any prehearing matter, will be permitted.”
